Selling food, supplements, cosmetics, or medical devices from Taiwan in the US requires FDA registration. Here's what applies to your product, how to register, and what happens if you skip it.
Not all products require FDA registration. FDA oversight applies to: food and beverages, dietary supplements, cosmetics, drugs and pharmaceuticals, medical devices, and veterinary products.
General consumer goods (kitchen tools, apparel, furniture, electronics not marketed as medical) do not require FDA registration. If your product is a purely mechanical or electrical item with no health/nutrition/drug claims, FDA is not your concern — focus on CPSC and FCC instead.
The most common categories where Taiwan exporters encounter FDA requirements: health supplements (vitamins, protein powders, TCM extracts), food products (snacks, beverages, functional foods), personal care products marketed with drug-like claims (anti-bacterial, SPF), and medical devices (blood pressure monitors, blood glucose meters, etc.).
Any facility that manufactures, processes, packs, or holds food or dietary supplements for US consumption must register with FDA under FSMA (Food Safety Modernization Act). This includes Taiwan factories exporting to the US.
Registration is free and done online at FDA's Unified Registration and Listing System (furls.fda.gov). You will need: facility name and address, a US Agent (a person or company in the US who FDA can contact on your behalf — required for foreign facilities), and a description of the food categories you produce.
Registration must be renewed every two years during the October–December window. Selling food or supplements from an unregistered facility into the US is illegal and can result in shipment detention at the US border.
US Agent services: Many regulatory consulting firms offer US Agent designation for $200–500/year. This is not a legal representative — just a contact point for FDA communications. Do not confuse this with a US importer of record.
Dietary supplements sold in the US must comply with DSHEA (Dietary Supplement Health and Education Act). The key labeling requirements: a "Supplement Facts" panel (not "Nutrition Facts" — these are different), a clear statement that the product is a dietary supplement, the net quantity of contents, and the manufacturer/distributor name and address.
What you CANNOT say on a supplement label: disease claims ("cures diabetes," "treats cancer"), FDA-unapproved drug claims. You CAN say: structure/function claims ("supports immune health," "promotes joint flexibility") as long as you include the disclaimer: "This statement has not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease."
Violation consequence: FDA can issue a warning letter, seize your product, and ban future imports. Amazon also suspends listings for supplement labeling violations.
As of 2024, the Modernization of Cosmetics Regulation Act (MoCRA) requires cosmetic facility registration with FDA — this is new and affects Taiwan cosmetic exporters. Facilities must register by July 1, 2024.
Products marketed as both cosmetic and drug (SPF sunscreens, anti-dandruff shampoos, anti-bacterial soaps) are regulated as drugs and require more extensive FDA approval. Avoid drug-cosmetic crossover claims unless you have gone through the OTC drug monograph process.

Possibly. Many established Taiwan food and supplement manufacturers that already export to the US will be FDA registered. Ask your supplier directly: "Do you have an FDA registration number?" If yes, get the number for your records. If no, the factory must register before you can legally sell their product in the US.

If you list without it, Amazon may remove your listing when their compliance team or a competitor flags it.
